OFFER AGREEMENT AND DATA PROTECTION

GENERAL PROVISIONS:

This agreement is an official and public offer from the Seller to conclude a contract for the purchase and sale of Goods presented on the website https://nihilistica.store/ (NIHILISTICA). This agreement is public, meaning that, according to Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers, regardless of their status (individual, legal entity, or sole proprietor), without giving preference to any particular buyer. By placing an order on the website, the Buyer unconditionally agrees to follow the terms of this Agreement and confirms that they have read and understood them.

DEFINITIONS:

• • In this offer, unless the context requires otherwise, the following terms have the following meanings:
    “Goods” – clothing, accessories, components, and related items;

• • “Online store” – according to the Law of Ukraine “On Electronic Commerce,” a means of presenting or selling goods, works, or services through an electronic transaction.

• • “Seller” – a company that sells goods presented on the website.

• • “Buyer” – an individual who has entered into a contract with the Seller under the terms set forth below.

• • “Order” – the selection of specific items from the list of goods, specified by the Buyer when placing an order and making a payment.

SUBJECT OF THE AGREEMENT:

• • The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

PRICES AND PAYMENT TERMS:

• • The prices of the goods are indicated on the Seller’s official online store.
    
    

• • Payment is made by transferring funds to the Seller’s account.

DELIVERY TERMS:

• • At the Buyer’s request, the Seller may ship the goods via Nova Poshta delivery services.

• • The terms and cost of delivery are specified on the carrier’s website.

CONFIDENTIALITY AND PERSONAL DATA PROTECTION:

• • By placing an order on the website, the Buyer consents to the collection and processing of their personal data in accordance with the Law of Ukraine “On Personal Data Protection.”

• • The Seller undertakes not to disclose the Buyer’s personal data to third parties, except in cases provided by law or necessary for order fulfillment (e.g., delivery services).

• • Personal data is used exclusively for order processing, execution, and providing information about promotions, special offers, and news from the online store (with the Buyer’s consent).

• • The Buyer has the right to request the modification or deletion of their personal data by sending a request to the Seller’s email.

RIGHTS AND OBLIGATIONS OF THE PARTIES:

• • The Seller is obligated to provide accurate information about the goods and their prices.

• • The Buyer agrees to pay for the specified Goods on time, according to the prices and conditions set by the Seller.

ВІДПОВІДАЛЬНІСТЬ СТОРІН:

• • The Seller and Buyer are responsible for fulfilling their obligations in accordance with the current legislation of Ukraine.

• • According to the Law of Ukraine “On Consumer Rights Protection,” the Buyer has the right to return Goods of proper quality within 14 days from the date of purchase. The exchange of goods of proper quality is possible if they have not been used and their commercial appearance, consumer properties, seals, and labels are preserved.

• • The Seller is not responsible for damages caused by improper use of the Goods by the Buyer.

ORDER PAYMENT PROCEDURE:

Payment for the order is made by the following methods:

• • Online payment via card

• • Payment via the LiqPay system

TERM OF THE AGREEMENT:

• • The electronic contract is considered concluded from the moment the person who sent the proposal to conclude such a contract receives a response accepting this proposal, as determined by part six of Article 11 of the Law of Ukraine “On Electronic Commerce.”
